Powers of Attorney and Guardianships

This is a field of growing public awareness, but it remains a field where professional guidance is essential. Many fit, healthy but prudent people, with an eye to the future, are granting, or at least considering whether they should grant powers of attorney to enable a trusty relative, friend or even professional adviser to look after their affairs and welfare should anything untoward come to afflict them. This is an easy matter to put off on with the attitude that one is fit and healthy but incapacity comes in many forms and ways, some of them extremely sudden. A car accident or a stroke can occur without regard to the age or health of the victim.

Guardianships and Intervention Orders should really only be a safety net as these are more expensive to set up, involving application to a Court supported by medical evidence, the insuring of the appointed person and then ongoing monitoring by the Public Guardian.

Powers of Attorney do not usually involve any of the foregoing but the granter must be able to understand what he or she is doing in granting a Power of Attorney.
